Court confirms foreigners can be deported if they only attempt a crime
The Federal Court in Lausanne has confirmed foreigners can be expelled from the country if they attempt to commit a crime.
The case reached the court as a Georgian national was fighting deportation after being arrested for attempted burglary in 2016. The man, with two accomplices, were trying to break into a house before being disturbed by the home owners. They were arrested shortly after.
The defendant tried to claim as the crime had not actually been completed, he should not be deported.
The court upheld a ruling in a lower court in Aargau which decided that it makes no difference if a crime was either completed or attempted.
